CMYKprintsolutions.com is a website (“Website”) owned and operated by CMYK Print Solutions, LLC (“CMYK”) offering printing consulting services. CMYK Print Solutions® is a registered trademark (Reg. No. 3,439,685).

Passive or active users of this Website (“User(s)”) are governed by the provisions of the General Terms and the Privacy Policy contained in these Terms of Use (collectively “Agreement”). If for any reason any User disagrees with any provision of this Agreement, such User must exit the Website immediately. CMYK reserves the right in its sole discretion to amend or change this Agreement without notice and such modifications shall be effective immediately upon their posting. It is each User’s sole obligation to periodically review this Agreement and ensure their use is in compliance with all current provisions contained herein. Access of the Website by Users constitutes full and unconditional acceptance of this Agreement in its form at the time of access. If User violates any of the terms of these Terms of Use, User’s permission to use the Website shall immediately terminate without the necessity of any notice. The access of any User to the Website may be suspended, restricted, or blocked by CMYK at its sole discretion without notice or obligation to provide cause.

All content, graphics, and designs on the Website are the property of CMYK and are protected by the intellectual property laws of the United States. Users may not print or reproduce in any manner any part or any derivative form of any portion of this Website in any media or format worldwide without the express written permission of CMYK, or in any way that contravenes such permission. Any unauthorized use, reproduction or distribution of such materials may result in severe civil and criminal penalties and will be prosecuted to the maximum extent possible under the law.

The Website may only be used by Users for lawful purposes. It is the sole obligation of the User to insure that their use is in compliance with all local, state, and federal laws that may have jurisdiction over their use.

Users shall not reverse engineer, decompile or disassemble any portion of the Website or tamper in any way with the operation of the Website, including by inserting or making use of any type of disabling device, including but not limited to, viruses, worms, Trojan horses, time bombs, cancelbots or any similar device that may impair, damage, or interfere with the proper working of the Website.

By using the Website, Users grant CMYK license to disclose and distribute any information provided through the Website, or directly to CMYK personnel, to third parties without limitation. Completion of the “Request for Quote” form on the Website does not create any expectation of performance or obligation on the part of CMYK to provide a quote. CMYK only requests quotes for Users from suppliers with which CMYK has previously established relationships. To which CMYK suppliers Users’ request for quotes are presented is at the sole discretion of CMYK. For which Users CMYK elects to provide quotes is at the sole discretion of CMYK.

Other than the provisions established by this Agreement governing the User’s use of the Website, no payment for services is made directly to CMYK by Users. CMYK provides consulting services free of charge to Users. Therefore, no contract for services exists between any User and CMYK. Acceptance of quotes by Users creates a direct, separate, and independent contract between the User and the selected CMYK supplier. Acceptance of a CMYK supplier quote by a User binds the User to the terms and conditions of the CMYK supplier contract independent from and in addition to this Agreement. CMYK does not arrange credit or payment terms for Users with CMYK suppliers. Invoices for services are sent directly from the CMYK supplier to the User.
Links to other websites are provided as a convenience only. CMYK makes no endorsement of the content or services of any website accessed through the Website. CMYK makes no representation that said websites will not cause damage to Users’ equipment or data. Users utilize any links to other websites through the Website at their own risk and hold CMYK harmless for any damages of any nature that may result from said use.

ALL USERS ASSUME ALL RESPONSIBILITY AND RISK THAT MAY RESULT FROM THEIR USE OF THE WEBSITE. THE CONTENT, INFORMATION AND SERVICES PROVIDED ON THIS WEBSITE ARE PROVIDED ON AN “AS IS” BASIS WITHOUT EXPRESS OR IMPLIED WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. CMYK DOES NOT WARRANT THAT THE CONTENT ON THE WEBSITE, OR CONTENT AVAILABLE THROUGH THE WEBSITE ON THE INTERNET, WILL BE WITHOUT ERROR OR WITHOUT VIRUSES OR OTHER POTENTIALLY HARMFUL ELEMENTS THAT MAY DAMAGE USERS’ EQUIPMENT OR DATA AND/OR INTERRUPT USERS’ ACCESS TO THE INTERNET.

ALL USERS ACKNOWLEDGE AND AGREE THAT THEY USE THE WEBSITE, ITS CONTENT, INFORMATION AND SERVICES, AT THEIR OWN RISK AND ARE SOLELY RESPONSIBLE FOR ANY DAMAGES TO THEIR EQUIPMENT, DATA, OR ANY OTHER DAMAGES INCLUDING BUT NOT LIMITED TO, INTERRUPTION OF INTERNET ACCESS AND LOSS OF BUSINESS, THAT MAY OCCUR AS A RESULT. 

CMYK DOES NOT ASSUME ANY LIABILITY OR RESPONSIBILITY FOR THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY CONTENT OR INFORMATION PROVIDED ON THE WEBSITE OR ANY CONTENT OR INFORMATION ACCESSIBLE THROUGH THE WEBSITE. CMYK SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY NATURE WHATSOEVER RESULTING FROM THE DIRECT OR INDIRECT USE BY USERS OF THE WEBSITE, ITS CONTENT, INFORMATION OR SERVICES, OR THE INFORMATION AND SERVICES PROVIDED BY CMYK, ITS OFFICES AND EMPLOYEES AS WELL AS ANY ATTORNEY’S FEES THAT MAY BE INCURRED BY CMYK TO DEFEND AGAINST ANY CAUSE OF ACTION RELATED TO SAID USE.

ALL USERS AGREE TO INDEMNIFY AND HOLD HARMLESS CMYK, ITS OFFICERS, DIRECTORS, EMPLOYEES AND ASSIGNS FROM ANY AND ALL LIABILITY WHATSOEVER ASSOCIATED WITH THEIR USE OF THE WEBSITE, ITS CONTENT, INFORMATION AND SERVICES AS WELL AS THE USE OF INFORMATION AND SERVICES PROVIDED BY CMYK, ITS OFFICERS AND EMPLOYEES. 

Should any provision of this Agreement be determined to be illegal or unenforceable, all other provisions shall be considered separate thereof and remain in full force and effect. The provisions and conditions of this Agreement represent the entire agreement between CMYK and User, and supersede any prior agreements or understandings not incorporated herein. Users may not assign any of their rights or duties under this Agreement. This Agreement will bind and inure to the benefit of each party’s permitted successors and assigns. This Agreement shall be deemed to have been entered into in the State of Ohio. Users waive any right to defense for lack of jurisdiction. Users and CMYK agree that venue for any action involving contract, tort, or common law shall be Hamilton County, Ohio or the Sixth District Federal Judicial Court, Cincinnati, Ohio. USERS AND CMYK WAIVE THE RIGHT TO JURY TRIAL.

CMYK collects the e-mail addresses of those who communicate with CMYK via e-mail and user-specific information that Users volunteer by completing pages on the Website, but CMYK does not collect information on Users who browse the Website.

The information CMYK collects is used to improve the content of the Website pages, to notify Users about updates to the Website, shared with agents or contractors who assist in providing services to Users, disclosed when legally required to do so at the request of governmental authorities conducting an investigation to verify or enforce compliance with the policies governing the Website and applicable laws or to protect against misuse or unauthorized use of the Website, and/or to a successor entity in connection with a corporate merger, consolidation, sale of assets or other corporate change respecting the Website.

With respect to cookies: CMYK does not set any cookies. If Users do not want to receive e-mail from CMYK in the future, please let CMYK know by sending an e-mail to the above address.

The Website contains links to sites. CMYK is not responsible for the privacy policies and/or practices on other sites. When linking to another site a User should read the privacy policy stated on that site. The CMYK Privacy Policy only governs information collected on the Website.

If any ads appear on the Website, they may be delivered to Users by CMYK or one of CMYK’s Web advertising partners. CMYK Web advertising partners may set cookies. These cookies allow the ad server to recognize a User’s computer each time they send the User an online advertisement. In this way, ad servers may compile information about where the User, or others who are using the User’s computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to Users. This Privacy Policy covers the use of cookies by CMYK and does not cover the use of cookies by any advertisers.

From time to time, CMYK may make the e-mail addresses of Users who access our site available to other reputable organizations whose products or services CMYK thinks Users might find interesting. If Users do not want CMYK to share their e-mail address with other companies or organizations, please let CMYK know by sending an e-mail to the above address.

If Users supply CMYK with their postal address on-line, they may receive periodic mailings from
CMYK with information on new products and services or upcoming events. If Users do not wish to receive such mailings, please let CMYK know by sending an e-mail to the above address.

Users who supply CMYK with their telephone numbers on-line may receive telephone contact from CMYK regarding requests for quotes or other information Users have requested through the Website.

From time to time, CMYK may use Users’ information for new, unanticipated uses not previously disclosed in this Privacy Policy. If CMYK information practices change at some time in the future, Users are bound by any minor changes to the Privacy Policy when they use the Website after those changes have been posted. If, however, CMYK is going to use Users’ personally identifiable information in a manner materially different from that stated at the time of collection, CMYK will notify Users by posting a notice on the Website for 30 days, during which period, a User may opt out of the new uses. If Users are concerned about how their information is used, they should check back at the Website periodically.

Users may prevent their information from being used for purposes other than those for which it was originally collected by e-mailing CMYK at the above address.

CMYK does not provide Users with access to information collected and maintained about them by CMYK. CMYK does not provide Users the ability to access and edit information collected and maintained about them by CMYK.

With respect to security: CMYK has appropriate security measures in place in its physical facilities to protect against the loss, misuse or alteration of information that CMYK has collected from Users on the Website.

If any User feels that CMYK is not following its stated Privacy Policy, the Users should contact CMYK by sending an e-mail to the above address.
